Please read these terms and conditions carefully before using Our Service.

Definitions

For the purposes of these Terms and Conditions:

  • Application means the software program provided by the Company downloaded by You on any electronic device, named KCALM
  • Company (referred to as either "the Company", "We", "Us" or "Our") refers to 14a0 Pty Ltd, Sydney, NSW, Australia.
  • Service refers to the Application.
  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service.

Acknowledgment

These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the Company.

By accessing or using the Service You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions then You may not access the Service.

You represent that you are over the age of 13. The Company does not permit those under 13 to use the Service.

License to Use

We grant you a non-exclusive, non-transferable, revocable license to use the KCALM application on your Device(s) in accordance with these Terms and Conditions.

You agree that:

  • You will use the Application only for personal, non-commercial purposes
  • You will not distribute or make the Application available over a network
  • You will not rent, lease, lend, sell, redistribute or sublicense the Application
  • You will not reverse engineer, decompile, or disassemble any portion of the Application

Health and Medical Disclaimer

IMPORTANT: The KCALM application is for informational purposes only and is not intended to be a substitute for professional medical advice, diagnosis, or treatment.

The nutritional information and calorie estimates provided by KCALM are approximations based on AI analysis and should not be relied upon for medical decisions.

Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition or dietary needs.

AI-Generated Content & Transparency

KCALM uses artificial intelligence to analyze food photos and provide nutritional estimates. In accordance with the EU AI Act, we disclose the following:

AI System Disclosure

  • When you submit food photos, you are interacting with AI systems that analyze and generate nutritional information
  • All calorie counts, macro breakdowns, and food identifications are AI-generated content and should be treated as estimates
  • AI-generated results may not be fully accurate and should not replace professional nutritional advice

Your Rights

  • You can manually override or edit any AI-generated nutritional estimates
  • You can request human review of AI decisions by contacting [email protected]
  • You can opt to manually enter food data instead of using AI analysis

Limitations

  • AI systems may misidentify foods, portion sizes, or nutritional content
  • Results may vary based on image quality, lighting, and food presentation
  • We continuously improve our AI systems but cannot guarantee accuracy

Third-Party Services

Our Service uses the following third-party services:

  • AI Service Providers (Google Gemini, Anthropic Claude, OpenAI): For AI-powered food image analysis and nutritional estimation
  • Supabase: For secure data storage and authentication
  • Expo: For push notification services
  • RevenueCat: For subscription and payment management

These third-party services have their own terms and privacy policies. We are not responsible for the practices or content of these third-party services.

Subscriptions, Auto-Renewal & Cancellation

Free Trial

  • If offered, free trials automatically convert to paid subscriptions unless cancelled
  • You will receive a reminder notification before your trial ends
  • Cancellation during the trial period will not result in any charges

Subscription Terms

  • Subscription fees are billed in advance on a recurring basis (monthly or annually)
  • Subscriptions automatically renew at the end of each billing period
  • You will receive a renewal reminder at least 24 hours before your subscription renews
  • Pricing may change, but you will be notified at least 30 days in advance

How to Cancel

You can cancel your subscription at any time through:

  • iOS: Settings → Apple ID → Subscriptions → KCALM → Cancel
  • Android: Google Play Store → Menu → Subscriptions → KCALM → Cancel

Cancellation is effective at the end of the current billing period. You retain access to premium features until your current period ends.

Refunds

  • Refunds are processed through the Apple App Store or Google Play Store
  • Statutory consumer rights under Australian Consumer Law are not affected
  • If our Service has a major failure, you are entitled to a refund under the Australian Consumer Law consumer guarantees

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever.

The entire liability of the Company shall be limited to the amount actually paid by You through the Service or $100 AUD if You haven't purchased anything through the Service.

"AS IS" Disclaimer

The Service is provided to You "AS IS" and "AS AVAILABLE" without warranty of any kind.

The Company does not warrant that:

  • The Service will meet Your requirements
  • The Service will be uninterrupted, timely, secure, or error-free
  • The results obtained from the Service will be accurate or reliable

Termination

By You

  • You may stop using the Service at any time
  • You may cancel your subscription at any time (see "How to Cancel" above)
  • Upon cancellation, you retain access until the end of your billing period

By Us

  • We may terminate or suspend your access for breach of these Terms
  • We will provide reasonable notice where possible, except for serious violations
  • Upon termination, you may request export of your data within 30 days

Consumer Rights (Australia)

Under Australian Consumer Law, you have certain rights that cannot be excluded:

Consumer Guarantees

  • Services will be provided with due care and skill
  • Services will be fit for any specified purpose
  • Services will be provided within a reasonable time

Your Rights if Something Goes Wrong

  • If there is a major failure with our Service, you are entitled to cancel and receive a refund for any unused portion
  • If there is a minor failure, we will fix it within a reasonable time

Nothing in these Terms excludes, restricts, or modifies consumer guarantees under the Australian Consumer Law.

Governing Law

These Terms shall be governed and construed in accordance with the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
